Most Supreme Court nominees are artists at NOT expressing political and ideological viewpoints for fear that candor will only serve to sink their chances.
Elena Kagan's nomination could change things. I'm still trying to gain access to the original University of Chicago site, but this story indicates Kagan has written that Supreme Court nominees should have to answer direct questions from senators about specific issues and pending cases. She's even criticized any confirmation process that avoids direction questioning as a "vapid and hollow charade."
I hope she sticks by this opinion. Direct answers will be refreshing, entertaining and will set the bar for future nominees who would no longer be able to hide behind the non-response response that has dominated every hearing since Bork.
